Terms and Conditions

• These Terms concern the purchase of products made remotely via a computer network on the website "www.farmaciadepaoli.com" belonging to the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas.
• Each purchase transaction will be governed by the provisions of Legislative Decree 185/99 and, as regards the protection of confidentiality, will be submitted to the rules as in Act No 675/96 and subsequent amendments.

The Customer, by sending electronic confirmation of your purchase order, unconditionally accepts and agrees to observe in its dealings with the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas the general conditions and payment conditions as described below in the order confirmation sent to the purchaser, stating to have read and accepted all the to him provided information under the rules described below, also notes that Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas itself does not feel bound to different conditions unless previously agreed in writing.

• The current Sales Terms must be examined online, after registration, by purchasers or eventual visitor purchasers of the website before they confirm their purchases. The submission of the confirmation order implies the full knowledge of the General Sales Conditions and their full acceptance.
• The Customer agrees and is obliged, once the on line purchase process is completed, to print and keep the General Sales Conditions, that are already examined and accepted during the purchasing process, in order to fully satisfy the conditions as described in Articles . 3 and 4 of Decree No 185/1999.

• www.farmaciadepaoli.com is a telematic website for the sales of dermocosmetic products, dietary products and medical devices.
• The prices of the products listed on the website are considered accepted without exception by the purchaser at the time of purchase confirmation.
• Before confirming the purchase, the customer will be shown the unit cost of each chosen product and the total cost in case of purchasing more products.
• Confirming the purchase, at completion of the transaction, the customer will receive a message by e-mail containing the date and the total amount of the order and the details of the ordered products.
• The order confirmation by Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas is done by sending an e-mail message and / or equivalent electronic documents (pdf file) that will have value at all effects of acceptance of the order by Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas. From this moment the contract is finalized and no right of withdrawal is allowed to be used.

The payment methods are described on the website.
Payment for the products must be done by the buyer via the prescribed and by the latter accepted method, by Credit Card.

• Purchased products will be delivered by the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas to the address indicated by the customer.
• Delivery of goods will take place during working days.
• The Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas uses for the delivery of the goods different carriers from time to time and they are freely chosen.

The carriers do not make phone calls nor handle any prior requests for shipments at particular times.
Delivery of the products will take a maximum of 5 working days, preferably within 72 hours from receiving the order, except in cases of force majeure.
The customer is required to verify that the package is complete and not damaged nor wet.
Only after such a check, the customer must accept the delivery, after which it will not be possible to oppose any dispute about the external characteristics of the delivered product in report to the made order. In case there is no correspondence between the order and delivery, the customer must inform the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas, via e-mail, fax or by telephone call within a maximum of 8 working days from the date of receipt of the goods.

• Products purchased through www.farmaciadepaoli.com are subject to the discipline, as applicable, under Decree No 02/02/2002 24 (OJ No 57, 8.3.2002) on sales contracts and guarantees relating to consumer goods and, to the extent if not provided for therein, the specific provisions provided by the Civil Code.
• This guarantee will apply to any product that should be free from defects regarding the inherent characteristics or the conformity of the primary and secondary packaging according to the standards of the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas.
• The guarantee is not applicable in cases of negligence and / or incorrect preservation and storage of the products.
• The eventual non compliance of the product must be reported within five (5) days from the receipt of the goods. The written complaint report should be enclosed by the customer to the shipment of the defective product to the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas: 25010 San Felice del Benaco, Via Santigaro, 32.
• The non-compliant product, in order to be subject to replacement, should, at the time of shipment to the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas, be complete with packaging and all accessories received by the customer at the time of purchase. The shipment of the product without the original packaging and accessories as mentioned above will prevent the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas from replacing the non-compliant product and makes it impossible to replace it. The non-compliant products that are returned to the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas have to be accompanied in the package of the returned shipment by the following documents: purchase invoice, number and date of the order, a brief description of the problem.
• The Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas reserves the possibility to verify, either directly or through other thereto assigned persons, the true nature of non-compliance of the purchased products.
• The products that are considered non-compliant by the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas will be replaced, following the sole and indisputable choice of the Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas, with products of the same quality, or with equivalent products of the same amount, or there may be issued a credit note for the value of the purchased products that are objectively considered as non-compliant.

This agreement is governed by the Italian law. For any dispute concerning the interpretation, validity or enforcement of this agreement, the competent court is the Court of Brescia with sub-office in Salo.

Farmacia del Dott. Francesco de Paoli Ambrosi e C. Sas at its indisputable decision, will still have the absolute right to cancel the order of the products in cases that do not comply with regulatory requirements.
